Wage Discrimination Alleged Against Sheltered Workshop

An intellectually disabled Sarnia man has filed a complaint with the Ontario Human Rights Tribunal alleging that the sheltered workshop in which he works is discriminating against him by failing to pay workers the prevailing minimum wage. This is an interesting and possibly difficult case involving issues relating to whether someone who works in a sheltered workshop is an "employee" and whether the minimum wage rules apply to such a workshop. At stake may be the continued viability of sheltered workshops, and how to balance the rights and needs of both the disabled workers and the limited resources of nonprofit workshop operators.
